Putting crews on notice fair and legal, Isle of Man ferry firm says

Putting officers who had not agreed to new live on-board contracts on notice was “fair, legal and proportionate”, a ferry operator has said.

Crew members affected were put on 12 weeks’ notice by the Isle of Man Steam Packet Company on Friday evening.

The new terms include crews living on-board the vessel during rest periods between shifts when working on the Manxman and Ben-my-Chree in future.

The union Nautilus described the step as a “new low for the company”.

The latest development in the ongoing row comes as ferry services between Douglas and Heysham resume following widespread disruption caused by gales.

The Steam Packet is a Manx government-owned company, which is run at arm’s length by a board of directors.

‘Least palatable option’

Nautilus, which represents 48 of the ferry firm’s 70 officers, said its members who had not agreed to the contracts had been issued with letters outlining plans to sack and then offer them re-employment.

The letter said notice had been served following legal advice in order to enable the company to implement the live on-board arrangements for all staff.

On Tuesday, Nautilus announced its officers would refuse to do overtime or act up to cover senior roles on the vessel from 18:00 GMT on 27 December.

It followed a ballot which showed 89% of its members backed taking action short of strike, with 81% willing to walk out.

In its latest statement, the Steam Packet said a lack of progress on negotiations had left it with “no choice but to take the least palatable option to resolving the ongoing dispute”.

Officers could sign the new contracts up to 15 March, the firm added.

‘I’m so angry I can’t think’

As the Skokie Village Board at its Dec. 18 meeting read through a routine ordinance establishing how much appointed officials should earn, tempers flared over allegations of impropriety leveled by the board’s sole independent trustee, James Johnson.

For his part, Johnson said he would walk out in protest if the proposed ordinance passes at the next meeting

Johnson said he was concerned that the proposed ordinance, which would need a second reading at the next village board meeting on Jan. 2, would take place before annual employee performance reviews. He urged his colleagues on the board to table the ordinance and asked if they wanted to recuse themselves from voting on the process, accusing them of having a conflict of interest with the village’s corporation counsel and assistant corporation counsel, Michael Lorge and James McCarthy, respectively.

Johnson has for months alleged conflicts of interest on the part of Lorge and McCarthy, accusing them of using village resources and time to protect the Skokie Caucus Party, Skokie’s dominant political party since the 1960s. He has made four ethics complaints to the village’s ethics commission since being elected in 2021; the commission has unanimously dismissed all four.

Johnson’s motion to table the ordinance died after not receiving any support from other village board members.

“I think it is so telling that this board is unwilling to do a performance review at this moment,” Johnson said.

Johnson accused the rest of the village board of having a conflict of interest in keeping Lorge and McCarthy employed because the two have made political contributions, solicited political contributions, sponsored fundraisers, volunteered and petitioned for their campaigns.

Americans beg for help getting family out of Gaza. “I just want to see my mother again,’ a son says

WASHINGTON — Fadi Sckak has already lost his father to the violence in Gaza. He wants to help his mother escape that fate.

“I just want to see my mother again, that’s the goal,” said Sckak, a university student in Sunnyvale, California. The 25-year-old is one of the Palestinian couple’s three American sons, including an active-duty U.S. soldier serving in South Korea. “Being able to hold her again. I can’t bear to lose her.”

His mother, Zahra Sckak, 44, was holed up Saturday with an older, ailing American relative in a Gaza City building along with 100 others. She is among what the State Department says are 300 American citizens, permanent legal residents or their parents and young children still trapped by the fighting between Israel and Hamas militants in Gaza.

Relatives in the United States and other advocates are pleading for the Biden administration and Congress to help them flee.

Gaza’s Health Ministry has reported more than 20,000 deaths in the fighting and more than 53,600 wounded. According to the United Nations, more than a half-million people are starving in Gaza because of the war.

Fadi Sckak’s mother was on her sixth day with only water from the sewers to drink and with little or no food and rescue hopes waning, he said. His dad, Abedalla, was shot and wounded last month, after a bombing forced the family to flee the building where they had been sheltering, and died days later without treatment, he said.

Their son had listened over the phone as his mother begged for help after the shooting. He could hear his 56-year-old father, who had diabetes and corresponding health problems, in the background, crying out in pain.

ATO given clear legal advice before launching ‘robotax’ debt campaign | Tax

The Australian Taxation Office received “clear advice” from the government’s chief legal adviser before launching a campaign to resurrect historical debts that caused widespread confusion and distress.

Meanwhile, the federal government has distanced itself from the tax initiative, arguing that decisions and processes related to the debts were a matter for the ATO.

A recent surge in debt collection activity, which included more than 200,000 letters sent to taxpayers and agents, stems from a policy change last year to change filters on the ATO’s systems that had previously ignored old debts deemed uneconomical to pursue.

Dubbed robotax, the initiative has drawn comparison to the flawed robodebt compliance program, given the reliance on automated processes that have the potential to cause financial harm.

As a result of the ATO’s 2022 policy change, thousands of Australians recently received debt notices ranging from a few cents to thousands of dollars, capturing everyone from retirees to workers and those on various support payments.

It created a situation whereby taxpayers were notified of decades-old debts worth less than the postage costs of sending out the letters. Other people were told they have larger debts, creating a situation that could rob them of tax refunds needed to pay rent, according to the tax ombudsman.

The debts are deemed “on-hold”, which means they are offset against refunds and credits rather than being due immediately.

Many of the alleged debts date back more than 15 years, and are linked to opaque PAYG and business activity amounts that bounced around credit and debit columns on tax statements, leaving taxpayers confused.

An ATO spokesperson said the agency’s approach to the old debts was reviewed by the National Audit Office in 2021-22, which recommended it update its policies. There was a concern that taxpayers may be getting a full credit from

Since October, a handful of legal organizations have been joining forces offering assistance to folks impacted after one of Maine’s worst days in history.

LEWISTON, Maine — After a mass shooting shook the Lewiston community, a handful of legal organizations are urging families and victims to seek out free legal advice thanks to a recent collaboration.

“‘What happens if my loved one didn’t have a will?’ All sorts of questions like that may come up that folks never have thought they would have to deal with, and shouldn’t have had to deal with,” Pine Tree Legal Assistance Executive Director Tom Fritzsche said.

Announced in a press release Thursday morning, anyone with questions or issues impacted by the Oct. 25 incident can seek free, civil legal support and advice from Pine Tree Legal Assistance, Disability Rights Maine, Legal Services for the Elderly, and the Maine Volunteer Lawyers Project.

“There’s all sorts of things that can actually be a civil legal need that can be more complicated than they think at first,” Fritzsche added. “We’ve made a special effort to make sure that for folks impacted by the tragedy in Lewiston, that there really is no wrong door to knock on.”

While all of the organizations have already been assisting those affected since October, they hope this call to action can help answer any uncertainties for folks impacted.

“This is a unique situation, and I think anything that we can do to make any piece of this easier and less traumatic for people, we’re ready to do that,” Riley Albair of Disability Rights Maine said.

New York Legal Assistance Group, advocates for asylum seekers in NYC, face looming budget cuts

NEW YORK – We’re taking a deep dive into New York City’s budget cuts, including how it will affect New Yorkers.

The cuts come at a time when New York City is seeing a record number of asylum seekers arrive.

A program that helps them get temporary protection status and work authorization is being cut.

“We just won asylum for a trans immigrant seeking asylum and protection in the United States,” said Jodi Ziesemer.

Ziesemer, of the New York Legal Assistance Group, provides services to low-income New Yorkers in need. The nonprofit group receives funding from the city and state, and has an immigration unit with 63 people.

“We’re focused on serving vulnerable immigrants, including recently arrived immigrants to New York,” Ziesemer said.

Over 150,000 asylum seekers have arrived in New York City since last spring. NYLAG says in addition to the city’s immigrants they’re already working with, they’ve been helping about 100 more a month. That’s compared to about 10-15 the same time last year.

“[The] city is looking to us to serve and to preserve these people’s rights, and they have cut our funding specifically for this program almost in half. We are trying to serve double the number of people with half the resources,” Ziesemer said. “We’re still trying to figure out what this budget cut is going to mean – whether it’s reducing the number of staff that we have or reducing the hours of our service.”

Attorneys at NYLAG say without their assistance, many asylum seekers will be at risk for deportation.

“We are seeing hundreds of people who have been ordered deported before they have a chance to apply for asylum or receive their work authorization,” Ziesemer said.

The real cost of “free” legal counsel

Hollywood has educated the public about what are known as Miranda Rights. Many TV cops have been heard advising suspecfts they have the right to remain silent. They are also obliged to tell suspects they have the right to consult with a lawyer, and if they cannot afford an attorney, one will be appointed for them. But here in Virginia, the Legal Aid Justice Center says poor defendants end up getting a bill.

“Low level misdemeanors might get charged $120 up to $1235 for certain types of felonies, and folks might have multiple criminal charges brought against them as part of the same case, so those fees can add up,” says Senior Attorney Pat Levy-Lavelle. That might not sound like much money to you, but for low-income defendants, it can be a disaster.

“People who are trying to juggle court debt bills have to decide, in a lot of cases, what not to pay,” says Levy-Lavelle. “Whether that’s getting behind on their housing payments or other consumer debt, that also can have spillover effects onto credit reports.”

The bill even follows some people to prison, where the state deducts from their earnings of less than 50 cents an hour.

“This debt is not frozen while people are behind bars,” he explains. “One of the gentlemen featured in our report was earning 45 cents per hour, and the courts were taking a portion of even that 45 cents per hour towards court debt.”
The state ends up collecting just over a third of what is due – often paying collection agencies much of the money. Legal Aid Justice is calling on the legislature to fully fund public defenders and stop sticking poor people with bills they can’t afford.
