Seattle-area eviction cases spike as pandemic aid dries up

Landlords across Washington filed nearly twice as many eviction cases in October as they did a year earlier, a stark increase after the end of the state’s final pandemic renter protections.

Facing more eviction cases and dwindling financial assistance, tenants are scrambling for help, attorneys are stretched thin and legal advocates are seeking relief from state lawmakers.

“It’s a nightmare,” said Edmund Witter, senior managing attorney for the Housing Justice Project in King County, where property owners and managers filed 600 eviction cases in October, the highest monthly total in at least seven years. King County tenant attorneys handle 30 to 40 eviction cases at a time, and, in an effort to juggle the growing number of cases, the organization recently shifted to helping tenants who are further along in the eviction process, Witter said.

Eviction filings are on the rise from Seattle to Spokane. Landlords filed more than twice as many cases in October than a year ago in King, Snohomish and Clark counties, according to data from the Administrative Office of the Courts and the Office of Civil Legal Aid. Filings were up 60% or more in Pierce and Spokane counties.

The increase marks a departure from last year, when some pandemic protections had lapsed but filings were still below pre-pandemic norms. Since then, the final protections have expired, including requirements that landlords offer payment plans and attempt mediation before evicting tenants. Cases picked up notably after those rules ended this spring and summer.

Yet the recent jump in eviction cases surprised even those who anticipated an increase.

Tenant attorneys expected an increase in cases in August and September, but “we were really shocked to see the most recent numbers,” said Philippe Knab, who manages the eviction defense program at the Office of Civil Legal Aid. The

Family of headteacher Ruth Perry refused legal aid for inquest into her death | Ofsted

The family of the headteacher Ruth Perry, whose death after a critical Ofsted inspection will be the subject of a high-profile inquest this week, have been refused legal aid to fund their representation just days before the hearing is due to start.

While other interested parties, including Ofsted, the local council and NHS trust, will – as public bodies – have their legal costs paid out of the public purse, the headteacher’s family say they have had to resort to crowdfunding to pay their legal costs.

As of Friday evening, more than £34,000 had been raised from more than 2,300 donations, including many from members of the teaching community in England who are closely following a case which has put the schools inspectorate under the spotlight.

The inquest is due to start at Berkshire coroner’s court on Tuesday. Perry’s family have previously said she was “devastated” and killed herself after an Ofsted inspection downgraded her school, Caversham primary, in Reading, from “outstanding” to “inadequate” over errors in safeguarding training and procedures.

The family’s Gofundme page points out that Ofsted, Reading borough council and Berkshire Healthcare NHS trust, as public bodies, “will de facto have their legal costs paid from the public purse”, but the bereaved family will receive no financial support. “We believe this legal and financial inequity to be unjust.”

The government’s position is that in the vast majority of inquests, families will not need their own legal representation as they are inquisitorial and the coroner is there to ask questions on the family’s behalf. There is also access to “exceptional case funding” in a small number of cases.

LEE COUNTY, Fla. — Nonprofit hosting a free limited legal advice presentation on adult guardianships at the downtown Fort Myers library Thursday.

Law at the Library is a quarterly conversation sponsored by Lee County Legal Aid Society with support from AARP Foundation.

Legal Aid fundraiser Freed to Run returns to Jacksonville

Berkley White, 82, almost lost his house for nonpayment of property taxes — even though he had been sending money to a loan-servicing company for that purpose.

White, currently in a rehabilitation hospital after a series of health crises, thinks he was taken advantage of because of his age. “I believe so. I’m not exactly a young man,” he said.

With the help of Jacksonville Area Legal Aid, the company’s planned sale of his house was halted. White still fears losing his house — his homeowner’s insurance is now requiring a new roof he cannot afford — but is grateful he’s not homeless. He particularly praised Marissa Vetter, a Legal Aid eviction grant manager and housing counselor.

“If not for Marissa, I don’t know where we’d be,” he said.

White is the kind of Legal Aid client that Mike Freed had in mind when he envisioned Shelter for Elders, a new endowment that will fund the agency’s housing-related legal assistance for indigent seniors. Proceeds from the 2023 Freed to Run Friday and Saturday, the latest incarnation of the Jacksonville attorney’s annual fundraiser for Legal Aid founded in 2017, will benefit that initiative.

Until this year, Freed to Run benefitted the Northeast Florida Medical Legal Partnership pairing lawyers, doctors and health care institutions to resolve legal problems affecting pediatric patients. Boca Raton attorney accused of killing his father found dead in Palm Beach County jail cell

WEST PALM BEACH — A disbarred Boca Raton attorney accused of murdering his father was found dead in his jail cell on Wednesday.

Brandon Labiner, 35, died of an apparent suicide by hanging inside the Palm Beach County Jail, a spokesperson for the county medical examiner’s office said. His autopsy report was not immediately available.

Labiner had been held at the jail without bail since his arrest in July following the slaying of his father, 68-year-old Paul Labiner, who was also an attorney. He had been scheduled to appear in front of Circuit Judge Cymonie Rowe for a status check on Nov. 28.

Paul and Brandon Labiner’s relationship was contentious in the year leading to Paul’s death. Paul Labiner filed a lawsuit against his son in September 2022, accusing him of stealing more than $500,000 from the trust account of Mindy Labiner, Paul’s wife.

In the lawsuit, Paul Labiner said the two had “a fairly good father-son relationship” until February 2022, when Brandon Labiner began exhibiting “bizarre behavior” that harmed Paul “physically, emotionally and financially.”

Paul Labiner said his son assaulted him in May 2022, causing an injury to his shoulder. Police were called to the scene.

Brandon Labiner was a personal-injury attorney who had worked in his father’s law practice before the two had a falling out. Brandon Labiner managed the personal-injury part of the practice, called the Personal Accident and Injury Law Center.

Local veteran able to stay in home thanks the legal help

Ohio is the home of over 600,000 veterans, around 97,699 of them live in homes with conditions, crowding, or cost issues, according to data from the Housing Assistance Council. Around 21% of veterans are paying more than they can afford for housing and around 630 veterans in the state are homeless.

One local veteran, Bilal Sabir, recently benefited from services that helped him to not become one of the homeless veterans. Sabir is a 74-year-old decorated former Marine who served in Vietnam when he was only 19 years old. He has received a Purple Heart and several other service awards for his efforts alone and with his unit.

Sabir and his wife were recently threatened with homelessness when a lien was put on their house by a contractor who tried to foreclose to receive payment. Sabir said at the beginning he was confused and worried since he didn’t have the money for an attorney to help him through the legal process. While he knew of Legal Aid he didn’t know that they had specific programs for veterans till a friend told him to check them out.

Free prescriptions and legal aid to end for benefit claimants not seeking work

Free prescriptions and legal aid will be cut off for benefit claimants who are deemed fit to work and do not seek employment as part of a Government crackdown.

Digital tools will also be used to “track” attendance at job fairs and interviews under the toughened sanctions regime, the Treasury has said.

Chancellor Jeremy Hunt said the measures were necessary to prevent “anyone choosing to coast on the hard work of taxpayers” from receiving benefits.

The changes are part of the Government’s £2.5 billion back-to-work plan, which it hopes will help up to 1,100,000 people look for and stay in employment.

This includes people with long-term health conditions, disabilities and the long-term unemployed.

Asked by journalists how denying access to free prescriptions would help to get people into employment, Downing Street said: “The approach does not take away the support and safety net that is rightly there for people that need it… It’s right that benefits are conditional on claimants meeting their reasonable work search responsibilities and it’s unfair that those in employment should subsidise the benefits of those who can work but choose not to.”

Ministers have said they will also expand support to encourage jobseekers finding and staying in work, including increasing the number of people receiving NHS talking therapy by 384,000 over the next five years.

As commission lawsuits mount, personal injury lawyers see an opportunity

As copycat commission lawsuits spread across the country in the wake of the Sitzer/Burnett jury verdict, a new demographic of plaintiffs’ attorneys are getting in on the action: so-called “ambulance chasers.”

While the plaintiffs in the Moehrl, Sitzer/Burnett and Nosalek lawsuits are all represented by large law firms with class-action experience, the plaintiff in the relatively small Burton suit in South Carolina is represented by attorneys at Knie & Shealy Law Offices in Spartanburg. The firm’s website advertises that it specializes in personal injury lawsuits.

“It’s not good,” Mike Ruggio, a partner at Taylor English Duma LLP and an antitrust law professor at Pittsburgh Law School, said.

“Whenever you see personal injury lawyers coming, it’s not a good sign. I hate to say it, but they can be kind of mercenary in how they go about things, and they look for the best percentages they can.”

Due to this, Marx Sterbcow, the managing partner at Sterbcow Law Group, fears the real estate industry may be in for a “death by a thousand cuts.”

“I could see this being brought out among states and having attorneys trying to basically create their own territory within one state to try and avoid multi-jurisdiction litigation or class actions,” Sterbcow said.

Although the number of copycat commission lawsuits has proliferated in the two weeks since the jury verdict in the Sitzer/Burnett suit was announced, these lawsuits potentially run the risk of being consolidated into a multi-jurisdiction litigation suit, as there are federal rules in place to prevent the wildfire-like spread of copycat lawsuits.

According to these rules, the first lawsuit filed will most likely survive while everything filed after may be dismissed, transferred or consolidated in with the initial lawsuit. However, if the issues raised, plaintiffs or defendants

Where Is Cannabis Legal? A Guide To All 50 States

Ohio became the 24th state to legalize adult-use cannabis and three other states could make recreational pot legal in 2024.

Voters legalized recreational cannabis in Ohio through a ballot measure on November 7, making the Buckeye State the 24th in the U.S. where adults 21 and older can possesses marijuana legally.

Ohio became the third state to legalize this year after Delaware and Minnesota. The state already has a robust medical cannabis market, which is expected to hit $520 million in sales this year, according to industry data firm BDSA. The adult-use market is slated to launch by the end of 2024 and could generate $1.65 billion in sales by 2027, according to BDSA.

With “ruby red” Ohio flipping to green, more than 50% of Americans live in a state where marijuana is legal, even though the federal government still outlaws the drug and considers it as dangerous as heroin. Paul Armentano, deputy director of nonprofit marijuana legalization advocacy group NORML, believes Ohio legalizing adult-use is a tipping point. “For the first time since the federal government initiated cannabis prohibition in 1937, more people now live in a place where marijuana is state legal, than reside somewhere it’s illegal,” says Armentano.

And he is not surprised that a conservative state like Ohio passed a cannabis legalization ballot measure with 57% of the vote. “When voters have the opportunity to go to the polls and decide whether they want marijuana legal, or whether they want to maintain prohibition, virtually every time they choose in favor of expanding freedom and civil liberties to responsible adults,” he adds.

In her column “Don’t leave rural Florida without care,” Rev. Cynthia Langston of Nocatee states correctly that “Medicaid expansion is not merely a policy decision; it is an expression of compassion and care for our neighbors.” She is correct, of course. Unfortunately, when Rick Scott, during his time as Florida’s governor, was offered $3 billion in Medicaid funding by the federal government, he turned it down, saying we didn’t need it. I hope all Florida voters remember that when Scott faces re-election next year.

Personal injury ads are the ‘most annoying thing on TV’ writer relates

I worked for many years as a claims adjuster and claims manager for a local company investigating accidents, fatalities and lawsuits. Many of the cases from the law firms just wanted to settle the case they didn’t want to go to trial and risk losing. There was a time when there was a minimum of damages before you could bring an action before the courts. That has apparently changed. Now you hear advertisements on TV about how much somebody got for their personal injury and how many billions the law firm has made over the years. The advertisements are the most annoying thing on TV. Even now when you drive down the highway you’re seeing billboards advertising attorneys, personal injuries and how much settlement they received for their injuries.

Nowadays, getting injured in a vehicle, an accident, slipping, falling or other type of accident is like a lottery. It’s easier to win. And you wonder why our homeowners insurance companies are raising their rates and also why your automobile insurance rates are accelerating so rapidly because of these frivolous lawsuits. I rest my case.

Legal Aid to have free clinic in Jennings County

JENNINGS COUNTY — Legal Aid will have a free Legal Aid Walk In Clinic for Jennings County community members on Tuesday, Nov. 21 at the Jennings County Public Library in North Vernon. The clinic will be from 3 to 5 p.m. and is for low-income residents.

The Legal Aid Clinic and Pro Bono Program utilizes local volunteer attorneys, offering free legal consultations to low-income individuals to those who might not otherwise be able to afford the counsel of an attorney.

Individuals coming to the Legal Aid Clinic can expect to receive a 10-minute consultation to answer general and eviction questions, offer legal information, or to receive other limited pro se assistance or advice, in person, on a first-come, first-served basis. There is no need to register in advance.

The general advice clinic for items such as adoptions, advance directives, family law, guardianships, protective orders, simple wills and small estates, is from 3 to 5 p.m.

The eviction clinic is from 4 to 5 p.m. covering negotiations with a landlord, legal defenses to an eviction damage hearings and eviction records. No criminal law questions will be answered.
